Supplemental Needs Trust

A Supplemental Needs Trust is typically a contingent provision. The Supplemental Needs Trust is only triggered if a beneficiary has a disability or is on government assistance.

Once triggered, the Supplemental Needs Trust springs into action and will supplement the needs of the disabled beneficiary (needs not covered by government support).

The Supplemental Needs Trust is structured to avoid disqualification of the beneficiary from their government assistance.

There is also a “poison pill” provision that ensures a creditor or government agency could not reach the assets in the Trust.
