Olivia K. Smith has been practicing law since 2007 and joined CMRS as a partner in 2015. Olivia currently accepts cases in the areas of Estate Planning, Medicaid Long Term Care Planning, Probate & Estate Administration, and Special Needs & Guardianship.

She enjoys these areas of practice because they allow her to work one on one with her clients. Olivia has extensive experience with domestic relations cases, including marriage termination and child custody. Divorce and other family conflicts can greatly impact your planning decisions. Olivia has now stepped away from actively practicing in domestic relations but will always leverage her experience to inform her clients on the right steps to take. Olivia has developed patience and listening skills through years of experience with conflict and litigation that she aims to transfer to her current areas of practice. She wants you to feel comfortable and never intimidated when meeting with her.

On a personal note, Olivia resides in Covington, Kentucky with her cat, Alfie. She has two special children in her life that are not biologically hers but are close to her heart. Because of these unique relationships and family structure, she also has a personal understanding of blended families and families without biological or adopted children. Olivia understands the complexities of family situations, which in turn allows her to provide an insightful and customized experience.

ESTATE ADMINISTRATION

Probate covers the entire legal process necessary to settle a person’s estate after their death. The appointed representative or executor (usually a family member) opens the probate case in court. Olivia will help you work through the financial business that the decedent left behind. For example, disposing of personal property, money, real property, or anything else the deceased owned at the time of their death. Probate also deals with any debts.

SPECIAL NEEDS

Caring for an individual with special needs is one of the most challenging and rewarding experiences for any family. Special needs planning can start at any point in life. However, planning as soon as possible can ensure significant government benefits aren’t jeopardized. This plan may include:

  • Establishing a first-party special needs trust
  • Establishing a third-party special needs trust

GUARDIANSHIP

If you’re caring for aging parents or another adult with declining health, guardianship may be used to protect their best interests. Guardianship should only be employed when a person’s mental or physical incapacity substantially impairs their decision-making ability. If your loved one has not prepared powers of attorney that allow someone to make decisions for them, you will need to seek guardianship.
